Thank you for applying to participate in the beta test of Hypershell Shelly. Please read and agree to the following terms before submitting your application.
1. Beta Eligibility
- This is a non-public beta test. Beta access will be reviewed and granted by Hypershell based on testing needs. Submitting an application does not guarantee that you will receive beta access.
- Beta access may only be used by the approved applicant. If the applicant is a company, media organization, institution, or other organization, access may only be used by personnel specifically approved by us.
- Without our prior approval, you must not transfer, sell, or share your beta eligibility or provide any beta account, password, testing link, invitation code, or other access credential to another person.
- We may adjust the testing period, scope, number of participants, or testing content based on testing progress. We may also suspend or end the test early or revoke beta access.
2. Beta Information Must Be Kept Confidential
Any non-public information that you access during the application process or beta test is confidential, including:
- Beta pages, features, workflows, and outputs;
- Screenshots, screen recordings, images, videos, and testing materials;
- Beta accounts, links, invitation codes, instructions, and communications;
- Unreleased product plans, features, launch schedules, and business information;
- Bugs, vulnerabilities, abnormal behavior, test results, and user experience;
- The fact that the beta test is taking place, that you have received beta access, or that the parties are discussing possible cooperation.
Without our prior written approval, you must not:
- Disclose, display, forward, or provide beta information to another person;
- Take screenshots, screen recordings, photographs, videos, copies, or downloads of beta content, except where expressly permitted for testing purposes;
- Post or discuss beta information on TikTok, YouTube, X, Facebook, Instagram, Reddit, forums, blogs, WeChat, Weibo, Xiaohongshu, Douyin, Bilibili, news media, livestreaming platforms, or any other public or semi-public channel;
- Publish reviews, user experience reports, news reports, livestreams, promotional materials, or any other external content relating to the beta test;
- Publicly disclose any bug, vulnerability, or security risk identified during testing.
If you become aware of any information leak, unauthorized account access, security vulnerability, or other abnormal event, please contact us promptly through support@hypershell.tech rather than publishing it publicly.
3. Rules for Using Beta Features
You may use the Beta Features only for normal testing, evaluation, and providing feedback to us. You must not use them for any other unauthorized purpose.
You must not:
- Impersonate another person or provide false or misleading application information;
- Share an account or allow an unauthorized person to participate in the beta test;
- Hack, reverse engineer, decompile, circumvent technical restrictions, or attempt to obtain source code, underlying models, or algorithms;
- Scrape, copy, download, or export system data in bulk;
- Attack or interfere with the testing system or disrupt another user’s use;
- Upload, publish, or distribute unlawful, infringing, fraudulent, harassing, or otherwise inappropriate content;
- Use the Beta Features for unlawful activities or in a way that harms us, other users, or any third party.
Beta versions may be incomplete and may contain errors, interruptions, data loss, or other problems. Do not use them to process important, sensitive, or irreplaceable data, or for production operations, medical, safety, financial, or other important purposes.
4. Application Information and Privacy
- Data Collection: To review your eligibility, contact you, organize the beta test, collect feedback, and protect testing security, we may collect and use the information you provide through the application form, including your name or nickname, contact details, occupation, organization, device information, testing interests, and other application information. The specific information collected will depend on the fields included in the application form.
- Data Processing: We will process the above information only to the extent necessary for application review, eligibility management, test organization, communications, security management, and compliance with applicable legal obligations, and will take reasonable security measures in accordance with applicable law.
- Third Parties: Unless we have obtained your consent, disclosure is necessary to achieve the purposes described above, or otherwise required by applicable law, we will not provide your application information to unrelated third parties.
- Data Retention: We will retain your application information only for as long as necessary to achieve the purposes described above, unless a longer retention period is required by applicable law. When the beta test ends or the relevant information is no longer necessary, we will delete or anonymize it in accordance with applicable law.
- Detailed Privacy Policy: If you are granted beta access, before you actually use the app or related Beta Features, we will separately present the detailed Privacy Policy applicable to the relevant app or feature. Personal information processing arising from your actual use of the app will be governed by that Privacy Policy.
Note: If you do not agree to our processing of your application information as described in this Section, please do not submit a beta application.
5. Feedback and Related Rights
- You may submit comments, suggestions, issue descriptions, bug reports, or other feedback in accordance with the testing instructions.
- Unless otherwise agreed in writing, we may use feedback voluntarily submitted by you, without charge, for product development, feature improvement, testing analysis, operations, and commercialization.
- Do not include in your feedback any third-party personal information, trade secrets, source code, copyrighted content, or other confidential information that you are not authorized to provide.
- All Beta Features, software, pages, content, trademarks, technology, and related intellectual property are owned by us or the relevant rights holders. Participation in the beta test does not give you any intellectual property or other ownership rights.
6. End of Testing and Deletion
- When the beta test ends, your beta access is revoked, or we request it, you must stop using the Beta Features and delete or destroy any saved screenshots, screen recordings, files, account information, and other non-public beta materials.
- Any content temporarily retained in an automatic backup must not be intentionally restored, accessed, used, or disclosed.
7. Breach of These Terms
If you breach these Terms, we may take appropriate measures, including:
- Rejecting your application, revoking beta access, or restricting or closing your beta account;
- Requiring you to stop the relevant conduct and remove any published or retained beta content;
- Requesting that the relevant platform remove unauthorized content;
- Disqualifying you from future beta tests, events, or cooperation;
- Pursuing remedies available under applicable law.
If your conduct causes loss to us, our affiliates, or any other party, you will be responsible in accordance with applicable law and must reimburse reasonable costs incurred in investigating, stopping, and addressing the conduct.
8. Other Information
- These Terms do not constitute a promise that we will provide beta access, a final product, compensation, a business opportunity, or any other benefit.
- If you apply on behalf of a company, media organization, institution, or other organization, you confirm that you are authorized to accept these Terms on its behalf and must ensure that relevant participants comply with them.
- By actively checking the acceptance box and submitting the application, you confirm that you have read, understood, and agreed to comply with these Terms. The relevant electronic records may be used as evidence of your acceptance.
- These Terms apply to the beta application process, the processing of application information, the confidentiality of beta information, and basic conduct during testing. When you actually use the app or related Beta Features, you will also be required to review and, as applicable, agree to the user agreement, privacy policy, and other applicable rules presented at that time. Personal information processing and product use arising from your actual use of the app will be governed by those documents.
